Welcome to the Aromoshelf ("we", "us", "our"). Before starting to use our website, products, services, and application (further jointly - the “Services”), please, read carefully these Terms of use in conjunction with the Privacy Policy that intends to provide legal guidance on defining the access conditions and use of Services by the user. These Terms of Use (the "Terms"), once you accept them by using the Services, are a binding contract between you and Aromoshelf arranging the conditions of the Services providing by the latter and using by you. Terms amendment
We are continually improving our Services, so we reserve the right to modify at any time the present Terms, particularly to adapt to the Services' evolutions by providing new features, and the deletion or modification of existing functionalities. We will bring it to your attention by placing a notice on the Aromoshelf mobile application ("app") in case the newest version of the present Terms is younger than you last accept hereof. In case of disagreement with the Terms, you are free to reject them, but that means you will no longer be able to use the Services. Further using our Services after a change to the Terms effectively means that you agree to these changes and amendments.
Age requirements to use the Services
We require users of our Services to be at least 16 years old. We do not intend for anyone under the age of 16 to use any of the features or Services we offer. If we find out or suspect you are less than 16 years old, we retain the right to limit, pause, or cancel your use of the Services in the way we may deem fit. How does the Aromoshelf app work?
After free downloading our mobile application through the App Store or Google Play and creating or signing up for your Services account, you will be asked to give your agreement to receive notifications from us and see your geolocation while using our app. The notifications will keep you up to date with new features and events inside the Services.Seeing your geolocation will help us analyze your fragrant experience, understand your preferences and perception of scents, and offer more accurate fragrance suggestions. We don't collect information about you; we collect and analyze information about your fragrances. The more details on how we collect, use, and store information you may see in the Privacy Policy.Once you sign up for your account, the Aromoshef app lets you catalog your collection and diarize your fragrance experience, giving you access to suggestions on what, when, and where to wear according to your location and weather in your region. In addition, you can share your opinions about the fragrances you wear, see what others are wearing, and learn more about perfumes by following other community members. Please, note that the app is going as it is. We are continually improving it, but we cannot guarantee that the current version meets your expectations or requirements.With your Services account created by you, upon proper authorization, you are free to use the app, the Aromoshelf website, and other parts of the Services within their prescribed technical features.If you want to save the image of the perfume bottle you already have or just sniffed in the shop to remember it, you'll need to allow us to access your camera or photo gallery. Otherwise, you can still use the app but without saving the pictures.
User Accounts
To use all the app functionality, you must create a user account within the Services by signing up with your Apple ID or Google account and adding your nickname. Please note that you are not obliged to use your real name while you can use your nickname or any other chosen name, provided that you can’t use a name you have not the right to use or use another person's name with the intent to impersonate that person. You may not transfer your account to anyone else without our prior written permission. You agree to immediately notify us of any unauthorized use of your Services account or any other breach of security.
You can permanently delete your app’s account and associated personal data via the Aromoshelf app in the profile settings or via this link: https://forms.gle/g4ur2wZz7Esu4uT16.
There are some restrictions on using the Services
By using the Services, you represent, warrant, and agree with some restrictions in using it and with the fact that violation of any of them is grounds for termination of your right to use or access the Services, including the app. You are not allowed:
to infringe or violate the intellectual property rights or any other rights of anyone else, including Aromoshelf;
to violate any law or regulation;
to use the Services in harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise in the sole discretion of Aromoshelf, objectionable manner;
to take actions that threaten the security of your account or anyone else's, including allowing someone else to log in to the Services as you or trying in any manner to obtain the password, account, or other security information from any other user;
to "crawl," "scrape," or "spider" any page, data, or portion of or relating to the Services or Content (as described below), through use of manual or automated means;
to decompile, reverse engineer, or otherwise attempt to obtain the source code or underlying ideas or information of or relating to the Services;
to publish or install information or hyperlinks in the Services that carry out commercial or advertising purposes without our prior authorization;
to sell rent, lease, license, assign, distribute, host, or otherwise commercially exploit the Services (except we authorize it).

You possess the following rights when using our Services
We do our best to grow and keep our database up-to-date and quickly fix technical problems. We welcome your feedback and may provide you with customer support. However, any feedback or suggestions you provide to us will be considered non-confidential and non-proprietary. As such, you agree that you will not submit us any information you consider to be confidential or proprietary.You may use the Services to comply with all laws that apply to you. We cannot be responsible for your use of the Services in a way that breaks the law.Please, do not share your account/password with anyone, and remember that you have to protect your account's security because you are responsible for any associated activities. You are responsible for all your activity connected with the Services and for keeping all your registration information accurate and up-to-date. At the same time, any activity, taken using or from your Services account, is deemed to be taken by you personally.
You may use all functionalities of our Services, including (but not limited to) storage of all information about your fragrance collection and user experience, sharing it with other users, obtaining recommendations, etc.
Questions related to the Content
You have access through the Services to all materials available here, including, but not limited to, text, graphics, data, articles, photos, logos, images, illustrations, other users' data and uploaded information, and so forth (further the "Content"). Aromoshelf does not guarantee that Content is free from defects, errors, or omissions and does not assume any liability for inaccuracies about products, whether based on manufacturer information, third-party information, our users' information, or rating and assessments generated by us. Please, remember that copyright and/or other intellectual property laws protect the Content. You should stick to all copyright notices, trademark rules, information, and restrictions. You won't use, copy, reproduce, modify, translate, publish, broadcast, transmit, distribute, perform, upload, display, license, sell or otherwise exploit for any purpose any Content not owned by you without the prior consent of its owner or in a way that violates someone else's (including Aromoshelf's) rights.
Remember that other users can see the content of your shelves, such as the perfumes and your rating to them.
If you found that one of our users infringed your copyright, please let us know. We respect others' intellectual property rights, and we reserve the right to delete or disable Content alleged to be infringing and terminate the accounts of infringers.
Please, remember that all Content you contribute to the Services will be visible to other users except your private notes on the fragrances. Like any other users, you are responsible for all Content you contribute to the Services in any manner. It may be (but is not limited to) photographs, pictures, text, sounds, text, etc. You are solely responsible for your Content. We are not responsible for your or somebody else's Content except the Content that Aromoshelf is an author.
We reserve the right (but have no obligation under these Terms) to review any Content generated by users, investigate, and/or take appropriate action against users, in our sole discretion, if they violate these Terms, including removing or modifying their Content, closing their Aromoshelf account, and/or reporting them to law enforcement authorities. We may also remove or modify Content generated by users if we believe that it violates the rights of, harms, threatens the safety of any other person, or creates liability for us or any other person. To cooperate with legitimate governmental requests, subpoenas, or court orders, or to protect our business and users, we may access and disclose any information considered necessary or appropriate that may include your username and usage history (i.g. the name of the settlement or region you wore your fragrances and weather), your Content, and temporarily stored IP-address.
You assume all risks associated with the Content you are publishing, including any disclosure of Your Content that makes you or any third party personally identifiable.
Any access to all Content is at your own risk, and we aren't liable for any errors or omissions in it nor for any damages or loss you might suffer in connection with it. We cannot control and have no duty to take any action regarding how you may interpret and use the Content or what steps you may take due to exposure to the Content, and you now release us from all liability for it. We can't guarantee the identity of any users with whom you interact in using the Services and are not responsible for which users gain access to the Services.
By submitting, posting, or displaying any content on or through the Services, you give Aromoshelf a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive license to reproduce, adapt, modify, translate, publish, publicly perform, publicly display and distribute it. We reserve the right at any time to remove any content Generated, submitted, posted, or displayed by you on or through the Services in case we find that it violates these Terms. You confirm and warrant to Aromoshelf that you have all the rights and authority necessary to grant the above license. It is strictly prohibited to publish or share Content or hyperlinks on Content that has information of an illicit, violent, polemical, pornographic, or xenophobic nature or which may affect the sensitivity of the most significant number of users. Such type of Content will be deleted, and your account will be banned.
Third-parties
Please, consider that the Services may contain links or connections to third-party websites or services that are not owned or controlled by Aromoshelf. You acknowledge that these Terms are creating contractual obligations between you and Aromoshelfand not with the App Stores or Google Play. We have no control over and assume no responsibility for the Content, accuracy, privacy policies, or practices of or opinions expressed on any third-party websites or by any third party you interact with through the Services. Also, Aromoshelf will not and cannot monitor, verify, censor, or edit any third-party site or service content. When you access third-party websites or use third-party services, you accept that there are risks in doing so and that Aromoshelf is not responsible for such risks. We encourage you to be aware when you leave the Services and to read the terms and conditions and privacy policy of each third-party website or service that you visit or utilize. Your interactions with organizations and/or individuals found on or through the Services, including payment and delivery of goods or services, and any other terms, conditions, warranties, or representations associated with such dealings, are solely between you and such organizations and/or individuals. It would be best if you made whatever investigation you feel necessary or appropriate before proceeding with any online or offline transaction with any of these third parties. You agree that Aromoshelf shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings. If there is a dispute between the Services users or between users and any third parties, you agree that Aromoshelf is under no obligation to become involved. If you have a dispute with one or more other users, you release Aromoshelf, its officers, employees, agents, and successors from claims, demands, and damages of every kind or nature, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way related to such disputes and/or our Services.
Aromoshelf is continuously developing and improving its Services so that they may change over time. We may suspend or discontinue any part of the Services, introduce new features, impose limits on certain features or restrict access to parts or all of the Services. We will notify you when we make a material change to the Services that would adversely affect you, but this is not always practical. Similarly, we reserve the right to remove any Content from the Services at any time, for any reason (including, but not limited to, if someone alleges you contributed that Content in violation of these Terms), in our sole discretion, and without notice.
Limitation on liability
Aromoshelf's recommendation system is based on the holistic approach to analyzing our dynamic database that includes (but is not limited to) customer experience, the technical characteristic of the products, and so on, and continuously developing and improving. That may give slightly different results at any given point in time. Any recommendations obtained from the Services are just recommendations and will not create any warranty not expressly made in these Terms or create any liability for Aromoshelf and its Services.
If, for some reason, using Services cause you to lose or about to lose any money or data, we are not responsible for that. The maximum amount you can sue us for is the amount that you have paid to Aromoshelf to use what we offer, and only in case, you do not receive what we offer and what you paid for or in case we breach your property rights. Accepting these Terms, you irrevocably waive all other reasons for claiming us or urging us to any activity or inactivity.
If we get sued or claimed by someone else because you did something illegal while using Services, you have to agree and take responsibility for your actions and reimburse us all the loss and expenses we incur in connection to such sue or claim - if any.
Using the Services, you, as well as other users, may leave some comments and indicate your expectations, reactions, suggestions, opinions etc. in such and similar cases we explicitly emphasize that that such expectations, reactions, suggestions, opinions etc. may, and in most cases they really do, differ from our expectations, reactions, suggestions, opinions etc. So that we do not share or support them and will in no case bear any liability in front of any person for any thought, phrase, or opinion proclaimed by anyone via our Services, in relation to them, or concerning any Services’ aspect, part, user or anything else.
Talking about the limitation of our liability we also directly proclaim that:
We are not responsible for the actuality, volume and terms of any price, proposal or discount, indicated on or via the Services and we give them only as a reference point for you to investigate them more precisely if interested.
If you switch to or go through appropriate reference to any store or other website of a third party, they leave the Services at your own discretion and at your own responsibility and you also get into the zone of action of other privacy policies and terms of use or other documents and rules, regulating appropriate store or website work, functionality and use of their users’ personal data.
We are not responsible if any stores you can see or get access to via of from the Services do not deliver the goods to your place of residence, or any purchase or delivery conditions are not acceptable for you.
Termination conditions
If you want to stop using our Services, you are free to do that at any time of your choice. Please refer to our Privacy Policy and the licenses above to understand how we treat the information you provide to us after you have stopped using our Services. By our side, we are free to terminate (or suspend access to) your use of the Services or your account for any reason at our discretion, including your breach of these Terms. Aromoshelf has the sole right to decide whether you violate any of the restrictions outlined in these Terms. Account termination may destroy any Content associated with your account.
However, there are some provisions hereof that, by their nature, should survive termination of these Terms or your ceasing to use the Services. By way of example, all of the following will survive termination: any obligation you have to pay us or indemnify us, any limitations on our liability, any terms regarding ownership or intellectual property rights, and terms regarding disputes between us.
